Little Rock, Ark. (February 7, 2022) – Wright Lindsey Jennings (WLJ) is pleased to announce the favorable resolution of the lawsuit filed against WLJ by the California-based owner of the Bank of America Plaza. The lawsuit filed by 200 West Capitol LLC was dismissed with prejudice.

“The building owner’s claim that WLJ had breached the lease agreement by failing to pay rent had no basis in fact or law, and the resolution of this suit is a clear indication of that,” said Steve Lancaster, managing partner of WLJ. “We look forward to working with a future owner to help bring the building back to its previous stability and stature in downtown Little Rock.”

In February of 2020, 200 West Capitol LLC and WLJ negotiated and entered into a third lease amendment where WLJ agreed to extend its lease term based on 200 West Capitol LLC’s agreement to make certain repairs. If the repairs were not made, WLJ was entitled to abate a portion of its rent payment in accordance with the third lease amendment. The repair and abatement clauses were expressly negotiated and included in the third lease amendment due to ongoing deterioration of the building. The required repairs were not completed, and WLJ properly exercised its contractual right to abate rent.

The suit filed in August by 200 West Capitol LLC alleged that WLJ was in default of the terms of the lease because WLJ had abated rent. This contention by 200 West Capitol LLC was without merit, as WLJ was enforcing the rent abatement clause in the lease agreement.
